The North Carolina Department of Environmental Quality’s Division of Water Resources has established interim maximum allowable concentrations, or IMACs, for eight per- and polyfluoroalkyl substances (PFAS) in groundwater. The Division received a request to establish IMACs on July 22, 2024. After reviewing the request, supporting materials and public comments, the Division Director has determined the IMACs will be protective of public health. S. 130A-309.24(j) and S.L. 2023-58, s. 2.(c). The rules provide additional detail, clarification, and consistency for the decommissioning and financial assurance requirements for utility-scale solar projects in G.S.
On October 1, 2024, the Environmental Protection Agency (EPA) published simultaneously a Proposed Rule and a Direct Final Rule entitled “North Carolina: Final Approval of State Underground Storage Tank Program Revisions, Codification and Incorporation by Reference” in the Federal Register under Docket # EPA-R04-UST-2024-0279. The proposed rule (FRL-12181-01-R4) provides for a 30-day comment period on the Direct Final Rule (FRL-12181-02-R4) North Carolina Final Approval on the State’s SPA application.
