Public Meeting: Buck and Belews Creek Facilities - Draft Consent Order

NOTIFICATION OF PUBLIC MEETING

Public notice of consideration to issue a State Consent Order to the following:

Duke Energy Carolinas, LLC (526 S. Church Street; Charlotte, N.C. 28202) has requested Special Order by Consent WQ S 18-004 for its Buck Steam Station and Belews Creek Steam Station to address issues related to seeps that emanate from the coal ash basins at those locations and potentially flow to adjacent surface waters.

In the statutorily-required, Periodic Review of Existing Rules, the “initial determination” of the 33 Dam Safety rules in 15A NCAC Subchapter 2K were approved for finalization by the Environmental Management Commission (EMC) at their May 2017 meeting. Proposed Rules Public Hearing (15A NCAC 18D Rules Governing Water Treatment Facility Operators)

Selected rules from 15A NCAC 18D are being reviewed for revision and readoption pursuant to G.S. 150B-21.3A. A total of eight rules have been identified as needing amendments that do not create substantial economic impact. The proposed amendments seek to correct technical errors, improve clarity, and/or reduce burden on the regulated community.

Public Hearing for Rulemaking for 15A NCAC 02S Rules and Criteria for the Administration of the Dry-Cleaning Solvent Cleanup Fund

A public hearing is being held for proposed rules in 15A NCAC 02S – Rules and Criteria for the Administration of the Dry-Cleaning Solvent Cleanup Fund, which are being readopted as part of the periodic review of existing rules pursuant to G.S. 150B-21.3A.  Proposed amendments to the rules include technical corrections, clarifications of form requirements and No Further Action Criteria, and an amendment to the definition of site specific target level to be consistent with risk-based standards in G.S. 130A-310.68.
