I.      Preliminary Matters

1.      Call to Order and Notice of NCGS §138A-15 (Chairman Puette)

General Statute §138A-15 mandates that the Chairman inquires as to whether any member knows of any known conflict of interest or appearance of conflict with respect to matters before the Environmental Management Commission’s Groundwater and Waste Management Committee. If any member knows of a conflict of interest or appearance of conflict, please so state at this time.

Approval of minutes from Groundwater and Waste Management Committee (GWWMC) meeting on January 10, 2018 (attached) and Special Called GWWMC meeting on February 7, 2018 (attached).

II. Action Items:

1. Request Approval to Proceed to the EMC for Public Comment and Hearing for 15A NCAC 13B Section .1100 Scrap Tire Management (Jessica Montie, DWM)

Explanation:  The Division of Waste Management seeks approval to proceed to the Environmental Management Commission in May 2018 for public comment and hearing for proposed amendments to rules in 15A NCAC 13B Section .1100 Scrap Tire Management.  The rules are proposed for readoption pursuant to G.S. 150B-21.3A.

Recommendation:  The Division recommends that the GWWMC approve the proposed amendments and readoption of rules in 15A NCAC 13B Section .1100 Scrap Tire Management to proceed to the EMC meeting in May 2018 for public comment and hearing.

III. Information Item:

1. Update on Readoption of 15A NCAC 13C Rules (Charlotte Jesneck, DWM - SF)

Explanation:  The Periodic Review of Existing Rules report for 15A NCAC 13C became effective June 24, 2017.  Section .0100 Notice and Section .0200 Prioritization were determined to be necessary without substantive public interest effective June 24, 2017.  Section .0300 Voluntary Remedial Action Oversight by Registered Environmental Consultants was determined to be necessary with substantive public interest and must be readopted by a deadline established by the RRC.  Due to the public interest in the .0300 rules, the Division has been conducting surveys and gathering input from affected parties.  The Division plans to work on proposed revisions to these rules with interested stakeholders while concurrently drafting new rules for pre-regulatory landfills.  Based on the level of interest, the Division intends to propose to the RRC for approval a readoption deadline of March 31, 2021.
