Special Order by Consent for 
Pilkington, North America, Inc. 
Laurinburg, Scotland County

Pilkington, North America, Inc. is a glass manufacturing facility in Laurinburg. The facility produces a product mix consisting of dark-tinted glass, light-tinted glass and regular clear glass. In addition to the current product mix, the FACILITY also produces low-iron clear glass (“LI Glass”). The facility is located at 13121 South Rocky Road, In Laurinburg, Scotland County, North Carolina.  

The facility currently operates under Title V Air Quality Permit No. 03873T37, which was issued on March 6, 2024, and has an expiration date of February 28, 2029. SECTION 2.1 B.6.c. and 2.1 B.7.d. requires the use of the continuous emissions rate monitoring system (CERMS) for NOx and CO to comply with 15A NCAC 02Q .0317: Avoidance Conditions and 15A NCAC 02D .0501(c): Compliance with National Ambient Air Quality Standards when LI Glass is produced. 

The facility has experienced persistent challenges with the operation and maintenance of the NOx and CO CERMS after the initial certification resulting in the multiple Notices of Violation/Notice of Recommendation for Enforcement (NOV/NRE) for exceeding the CERMS allowable quarterly monitor downtime threshold. 

Pilkington, North America, Inc. has agreed to a Special Order by Consent (SOC) with the North Carolina Environmental Management Commission (EMC) to allow the Pilkington, North America, Inc. facility to continue to operate while DAQ is processing its Significant Title V Air Permit Modification Application. Per the terms of the SOC, the owner/operator of the facility must comply with all terms and conditions of Air Quality Permit No. 03873T37. The SOC includes an upfront penalty and enforcement action pursuant to N.C.G.S. § 143-215.114A for failure to comply with any terms or conditions specified in Air Quality Permit No. 03873T37 or the SOC. The SOC will expire when DAQ takes final action on the facility’s permit modification application.

Interested persons are invited to review the proposed SOC and to submit written comments by email to daq.publiccomments@deq.nc.gov with “Pilkington, North America, Inc. SOC” in the subject line or by mail to one of the above addresses. Any person requesting a public hearing regarding the proposed SOC should submit a written request with a statement supporting the need for such a hearing. The request for hearing should be sent to the DAQ at one of the two above address or at the above email address. 

All public comments and requests for hearing must be received by 5 p.m. on January 2, 2026. 

The Director of the DAQ shall take final action on behalf of the EMC on Consent Orders within 60 days of the initial public notice.
