PUBLIC NOTICE: North Carolina Department of Environmental Quality, Division of Waste Management, Solid Waste Section Seeking Comments on Industrial Landfill Draft Permit Number 1119-INDUS-2020
The Division of Waste Management’s Solid Waste Section will conduct a public hearing on Dec. 19, 2019 at 6 p.m. in the A-B Tech Community College Conference Room B, located at 340 Victoria Road in Asheville. This hearing is in regards to draft Permit Number 1119-INDUS-2020 for the construction and operation of an industrial landfill at the Duke Energy Progress, LLC (Duke Energy) – Asheville Steam Electric Plant, pursuant to the Department of Environmental Quality’s rules at North Carolina Administrative Code 15A NCAC 13B .0503 through .0505.
Permit Application
Duke Energy submitted a new permit application on June 17, 2019. The application requested permit approval to construct the 12.5-acre landfill and approval to operate once it is constructed and approved by the Solid Waste Section. The Division of Waste Management has determined that the application satisfies the requirements of North Carolina Administrative Code 15A NCAC 13B .0503 through .0505. A draft permit has been prepared for public review.
North Carolina General Statute (NCGS) 130A-309.203 (Coal Ash Management Act of 2014 or CAMA) requires that the public be given a 60-day period to comment on this draft permit. The comment period will begin November 11, 2019, and end at 5 p.m. on January 10, 2020.
The application and draft permit are available for review by appointment from 9 a.m. to 4 p.m., Monday through Friday, at the N.C. Department of Environmental Quality’s Central Office located at 217 West Jones Street in Raleigh, NC 27603. Duke Energy Progress, LLC owns and operates the Asheville Steam Electric Plant (Facility), located at 200 CP&L Drive in Asheville (Buncombe County), North Carolina. The Facility is an electrical power generating facility and includes a total area of approximately 4,326 acres.
Industrial landfill Permit Number 1119-INDUS-2020 is a new landfill permit that once completed will receive industrial solid wastes from Duke Energy’s Asheville Steam Electric Plant, including coal combustion residuals (CCR) including fly and bottom ash; pyrites and coal mill rejects; boiler slag; waste water treatment sludge; petroleum contaminated soils and other waste soils; small quantities of co-mingled vegetation and CCR, waste limestone, or abrasive blast material; inert debris from CCR unit decommissioning activities; vacuum truck waste; and soil that contains any of the above material or is used as cover. The industrial landfill covers approximately 12.5 acres and will be permitted to include one phase with a total disposal capacity of approximately 1.1 million cubic yards. The operational life of this facility is estimated to be approximately 2.5 years. This landfill will enable Duke Energy to complete excavating coal ash at the Asheville Steam Plant as directed by Session Law 2014-122 (CAMA).
Public Hearing
The Division of Waste Management’s Solid Waste Section will conduct a public hearing on Dec. 19, 2019 at 6 p.m. in the A-B Tech Community College Conference Room B, located at 340 Victoria Road in Asheville.
Interested parties may submit oral or written statements and data concerning the proposed facility permit. Persons wishing to speak may register at the hearing. Speaking times will be allotted per speaker as time allows. You may also submit comments by email to publiccomments@ncdenr.gov.
