Currently, ammonia nitrogen, fecal coliform, and total residual chlorine are water quality limited. This discharge may affect future allocations in this portion of the receiving stream. PUBLIC NOTICE STATE OF NORTH CAROLINA ENVIRONMENTAL MANAGEMENT COMMISSION 1617 Mail Service Center Raleigh, North Carolina 27699-1617 Notification of Intent to Issue a Consent Order Public notice is hereby given of intent to issue a State Consent Order to the following: Perdue Agribusiness LLC (242 Perdue Road, Cofield, NC 27922) has requested a Special Order by Consent No. S24-003 for its Cofield Facility, a 347,000 GPD wastewater treatment facility operating under discharge permit NC0089516. The request stems from the facility’s inability to consistently meet permit conditions and final effluent limits for whole effluent toxicity as required in the NPDES permit NC0089516. The Cofield Facility discharges treated wastewater to an unnamed tributary to Deep Creek in the Chowan River Basin. The Environmental Management Commission proposes to issue the Order under Article 21 of Chapter 143 of the North Carolina General Statutes, with an effective date of June 25, 2025. Compliance with this Order will require Perdue Agribusiness LLC to prepare plans and specifications for construction and operation of additional treatment works to attain full compliance with final effluent limits in Permit NC0089516. The company must comply with all NPDES permit limits except for interim effluent limits specified in the Order. The Order will expire on April 1, 2030.
