Summary of Post-Construction Programs

In North Carolina, there are a variety of post-construction programs. The Post-Construction Stormwater Map indicates which program applies and the applicable jurisdiction to contact. 

We do our best to make the map as accurate as possible, it is advisable to check with the local government if the map shows that your project is not subject to a stormwater program.

Stormwater Programs Implemented by DEQ

Program Name w/ Rule Link Description of Program
Coastal Counties New development projects within twenty coastal counties require State Post-Construction Stormwater Permits from the Wilmington and Washington Regional Offices.  
Outstanding Resource Waters and High Quality Waters  New development projects within ORW and HQW watersheds outside of the coastal counties require Post-Construction Stormwater Permits from the DEMLR Central Office.
MS4 Tipped Areas This program applies to areas that are subject to federal population criteria for MS4 inclusion but are outside of a permitted MS4 entity's jurisdiction.  New development projects in these areas require Post-Construction Stormwater Permits from the DEMLR Central Office.
Goose Creek Stormwater Any new development activity that disturbs one acre or more of land within the Goose Creek watershed and will add built-upon area shall control and treat the difference in the stormwater runoff from the predevelopment and postdevelopment conditions for the one-year, 24-hour storm.  Local governments may request delegation of this program from DEQ.

Stormwater Programs Implemented by Local Governments

Water Supply Watershed Protection Program  Requires that all local governments having land use jurisdiction within water supply watersheds adopt and implement water supply watershed protection ordinances, maps and management plans. Neuse NSW Stormwater Program

The following local governments are required to limit nutrient runoff from new development projects:

  • Municipalities:  Cary, Durham, Garner, Goldsboro, Havelock, Kinston, New Bern, Raleigh, Smithfield, Wilson
  • Counties:  Durham, Johnston, Orange, Wake, Wayne
Tar-Pamlico NSW Stormwater Program

The following local governments are required to limit nutrient runoff from new development projects:

  • Municipalities:  Greenville, Henderson, Oxford, Rocky Mount, Tarboro
  • Counties:  Beaufort, Edgecombe, Franklin, Nash, Pitt
Falls Lake NSW Stormwater Program Local governments with land use authority in the Falls Lake watershed are required to achieve and maintain nutrient loadings objectives established for new development projects.
Randleman Lake Stormwater Local governments with land use authority in the Randleman Lake watershed are required to create and implement comprehensive stormwater management plans and issue high and low density permits for new development projects.
Universal Stormwater Management Program Local governments may request a Universal Stormwater Program from DEQ to supercede most of the stormwater programs within their jurisdictions.
